The REBNY COVID-19 Health Questionnaire Screening Form is designed to help promote the health and safety of all participants who may be involved with in-person showing or meeting activity for residential and commercial real estate in New York City. The questionnaire is just one of many precautionary measures being taken by real estate participants in NYC to prevent the spread of COVID-19.
The Questionnaire is distributed to all attendees within 24 hours of any scheduled meeting or showing. Participants are required to complete and sign the form prior to attending any in-person activity.
The latest version of the Questionnaire asks the following questions:

Have you knowingly been in close or proximate contact in the past 14 days with anyone who has tested positive for COVID-19 or who has had symptoms of COVID-19?

In the last 14 days, have you traveled from another state or country for which New York State requires a mandated self-quarantine period?

How Should the COVID-19 Health Screening Questionnaire be Used?
The form should be provided to all parties who will be involved in a showing, meeting or any other form of in-person activity. The listing agent is customarily responsible for sending the forms to all parties. If the owner her or himself or another third party is involved in coordinating visits, the appropriate party doing the organizing should send out the paperwork to all individuals.
When Should the Health Screening Questionnaire Be Provided and Filled Out?
The form should be provided to and filled out by all parties involved with the visit within 24 hours of the scheduled in-person activity. The refusal or failure to answer each question may result in the cancellation of any scheduled meeting or showing, and the Broker reserves the absolute right, in their sole discretion, to refuse entry to non-compliant individual(s).

Are Agents Required to Present the Health Questionnaire to All Consumers?
Yes. When utilizing the REBNY Health Screening Questionnaire form, the Broker represents that they use and present this Form uniformly and in the same manner for all in-person interactions and meetings and in accordance with all Federal, State and Local Fair Housing Laws. Failure to use the Health Screening Questionnaire Form in a consistent and equal manner may expose the Broker to allegations of Fair Housing violations.
What If a Participant Tests Positive After a Showing?
Any participant involved with an in-person real estate activity must notify the real estate licensee listed below if they become symptomatic and/or test positive for COVID-19 within 48 hours of the last visit to the property.
What Other Acknowledgments Are Included in the Form?
By signing the form, the signatory acknowledges and agrees that:
(i) information requested on this Form is being provided voluntarily
(ii) the information provided on this Form is confidential and is not intended for use outside of determining whether an in-person showing or meeting can occur
(iii) the refusal or failure to answer each question below may result in the cancellation of any scheduled meeting or showing, and that the Broker reserves the absolute right, in their sole discretion, to refuse entry to that person
(iv) if the answer to any of the questions below is “Yes” that person will not be permitted to attend the in-person showing or meeting
(v) any person may be asked in the future to execute another Form in connection with a future meeting and/or showing; and (vi) they must notify the real estate licensee listed below if they become symptomatic and/or test positive for COVID-19 within 48 hours of the last visit to the property. The Broker represents that they use and present this Form uniformly and in the same manner for all in-person interactions
